These Website Terms & Conditions ("Terms") govern the use of the Gun World Australia website and all purchases made from Gun World Australia ("we", "our", "us"), whether online, by telephone or in-store.

By accessing our website or placing an order, you acknowledge that you have read, understood and agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years of age to purchase firearms, ammunition, knives or any other age-restricted products from Gun World Australia.

By placing an order, you warrant that:

the information you provide is accurate and complete;
you are legally entitled to purchase the products ordered;
you will comply with all applicable Commonwealth, State and Territory laws.

2. Product Availability

All products displayed on our website are subject to availability.

We reserve the right to discontinue products, limit quantities or refuse supply at any time without prior notice.

Photographs are provided for illustration purposes only and may differ slightly from the actual product supplied.

3. Pricing

Unless otherwise stated:

all prices are in Australian Dollars (AUD);
prices include GST where applicable.

Although every effort is made to ensure pricing accuracy, errors may occur. Where a pricing error is identified before dispatch, we reserve the right to cancel the order and provide the customer with the option of:

receiving a full refund; or
purchasing the product at the correct price.

Quoted prices remain valid for 14 calendar days unless otherwise specified in writing.

4. Order Acceptance

Submitting an order does not constitute acceptance by Gun World Australia.

Orders become binding only after:

payment requirements have been met;
all required licences and identification have been verified;
stock availability has been confirmed; and
the order has been accepted by Gun World Australia.

We reserve the right to refuse or cancel any order where:

stock is unavailable;
pricing errors occur;
required documentation is not supplied;
legal requirements cannot be satisfied; or
fraudulent or suspicious activity is suspected.

5. Payment

Payment must be received in full within three (3) calendar days of placing an online order unless otherwise agreed in writing.

Orders that remain unpaid after this period may be cancelled without notice.

Cancelled orders will be returned to available stock.

Customers requiring additional time should contact us before the payment deadline expires.

6. Special Orders

Products specially ordered for a customer require a minimum 25% deposit, unless otherwise agreed.

The remaining balance is payable within 14 days of notification that the goods have arrived.

If payment is not received within this period, Gun World Australia may cancel the order and retain all or part of the deposit to recover reasonable administration, supplier and restocking costs, to the extent permitted by Australian Consumer Law.

7. Lay-by

Lay-by is available on selected products only.

Lay-by conditions include:

minimum 25% deposit;
maximum lay-by period of eight (8) weeks from arrival of goods;
regular fortnightly payments.

Failure to complete payments within the agreed period may result in cancellation.

Where a lay-by is cancelled by the customer or defaults, Gun World Australia may retain a 20% administration and restocking fee, with any remaining funds refunded where required by law.

8. Shipping

Shipping charges are calculated according to:

destination;
parcel size;
parcel weight; and
freight carrier.

Minimum shipping charge: $15.00

Large or bulky items may incur additional freight charges.

Customers are encouraged to contact us for a freight quotation before ordering oversized items.

9. Delivery

Orders are generally dispatched using Australia Post eParcel or another suitable carrier.

Signature on delivery may be required.

Delivery timeframes are estimates only.

Depending on stock availability and destination, delivery may take up to 28 days.

Gun World Australia is not liable for delays caused by freight providers or circumstances beyond our reasonable control.

10. Dangerous Goods

Dangerous Goods including:

ammunition;
gunpowder;
primers; and
other hazardous products,

are generally available for In-Store Collection Only, unless lawful transport arrangements are available.

11. Identification Requirements

Certain products require identity verification.

Customers purchasing knives may be required to provide government-issued photo identification.

Customers purchasing firearm parts may be required to provide a current firearms licence before dispatch.

Failure to provide requested documentation may delay or cancel the order.

12. Firearms

All firearm transactions are conducted in accordance with applicable Commonwealth, Queensland and relevant State or Territory legislation.

Queensland

Firearms may be shipped directly to licensed Queensland customers after licence verification.

Interstate

All interstate firearm purchases must be shipped to a licensed firearms dealer nominated by the purchaser.

Customers are responsible for:

ensuring they are legally entitled to possess the firearm;
providing accurate licence information;
nominating a receiving dealer where required;
complying with all applicable firearms legislation.

13. Ownership and Risk

Ownership of goods remains with Gun World Australia until:

full payment has been received; and
all legislative requirements have been satisfied.

Risk passes to the customer upon delivery.

14. Returns and Refunds

Our Returns & Refund Policy operates in accordance with the Australian Consumer Law.

Nothing in these Terms excludes your statutory consumer guarantees.

Returns for change of mind may be accepted at our discretion and may be subject to:

products being unused and in original condition;
original packaging being intact;
proof of purchase being provided; and
reasonable restocking fees where applicable.

Special order items may not be eligible for change-of-mind returns.

15. Gift Vouchers

Gift vouchers:

are valid for 12 months from the date of issue unless otherwise required by law;
are not redeemable for cash;
must be presented upon redemption.

16. Store Credits

Store credits:

do not expire unless otherwise stated;
may only be redeemed for purchases;
are not redeemable for cash except where required by law.

17. Limitation of Liability

To the fullest extent permitted by law, Gun World Australia shall not be liable for indirect, incidental or consequential loss arising from the use of our website or the purchase of our products.

Nothing in these Terms limits or excludes any rights that cannot lawfully be excluded under the Australian Consumer Law.

18. Privacy

Personal information is collected, stored and used in accordance with our Privacy Policy and applicable Australian privacy legislation.

Information provided for firearms licensing and identification purposes will be handled securely and only used as required by law.

19. Intellectual Property

All website content including text, graphics, logos, photographs and product information remains the property of Gun World Australia or its licensors.

No material may be reproduced without written permission.

20. Governing Law

These Terms are governed by the laws of Queensland, Australia.

Any dispute arising from these Terms shall be subject to the jurisdiction of the courts of Queensland.
